  • Sober Immigration Inc. is a registered and licensed immigration consulting firm regulated by the College of Immigration and Citizenship Consultants (CICC).
  • All consultations and services provided are subject to the Retainer Agreement signed between the client and the Company.
  • The information provided on our website is general in nature and does not constitute legal advice. Individual circumstances may vary, and professional advice should be obtained through a formal consultation.

3. Eligibility to Use Our Website

By accessing or using our Site, you represent and warrant that:

  • You are at least 18 years of age, or accessing with the consent of a parent/guardian.
  • You will use this Site in compliance with all applicable Canadian laws and regulations.
  • You will not use the Site for fraudulent, harmful, or unlawful purposes.

6. Payments, Fees, and Refunds

  • All service fees will be clearly outlined in the signed Retainer Agreement.
  • Payments must be made in Canadian Dollars (CAD) unless otherwise agreed.
  • Refunds, if applicable, will be provided only as per the Retainer Agreement and in accordance with Ontario's Consumer Protection laws.
  • Government fees (IRCC, CBSA, provincial offices, etc.) are separate from our professional fees and are non-refundable once paid.

7. Limitation of Liability

  • Sober Immigration Inc. provides services on a best-efforts basis and does not guarantee visa approvals, immigration outcomes, or timelines, as these are determined by Canadian government authorities.
  • We shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our Site or services.
  • You agree that your sole remedy for dissatisfaction with the Site or services is to discontinue using them.

8. Client Responsibilities

Clients engaging our services agree to:

  • Provide truthful, accurate, and complete information and documentation.
  • Cooperate with timelines and instructions provided by our team.
  • Understand that withholding or misrepresenting information may result in delays, refusals, or legal consequences.

9. Non-Disparagement Clause

You agree not to publicly post, publish, or communicate any false, misleading, or defamatory statements whether online, on social media, review platforms, or otherwise that could harm the reputation, credibility, or business interests of Sober Immigration Inc., its directors, employees, or affiliates.

  • Constructive feedback is welcomed and may be addressed directly through our internal complaint-handling process.
  • This clause does not restrict your right to express truthful opinions, make complaints to regulatory authorities (such as the CICC or the Office of the Privacy Commissioner of Canada), or exercise any rights protected under Canadian law.

9.1 Liquidated Damages for Breach

If you breach this Non-Disparagement Clause, you agree that such a breach would cause substantial harm to Sober Immigration Inc. that may be difficult to quantify. Therefore, you expressly agree to pay:

  • Liquidated damages in the amount of not less than CAD $25,000 per violation, and
  • All reasonable legal fees, collection costs, and related expenses incurred by Sober Immigration Inc. in enforcing its rights under this clause.

This amount is agreed to be a genuine pre-estimate of damages suffered by Sober Immigration Inc. and not a penalty.

10. Website Availability & Technical Issues

  • We strive to ensure continuous availability of our Site but do not guarantee uninterrupted or error-free access.
  • We are not responsible for service interruptions caused by third parties, technical failures, or force majeure events.

11. Third-Party Links

Our Site may include links to third-party websites for informational purposes. We are not responsible for the content, privacy practices, or accuracy of information on external sites.
